1Role of Sportal (Intermediary Disclaimer)

Sportal acts strictly as an intermediary technology platform designed to facilitate bookings, matchmaking, and tournament management. Sportal does not own, operate, or manage any of the Venues listed on the Platform.

• We do not guarantee the quality, safety, or legality of the physical venues.
• We are not a party to the agreements entered into directly between Users and Venues.
• Sportal shall not be held liable for any physical injuries, damages, or losses incurred at any Venue.

2Terms & Conditions for Users

2.1. Account Registration & Conduct

Users must provide accurate information during registration. Users agree to use the Platform respectfully. Harassment, abusive language in chats, or exploiting the matchmaking system will result in immediate account suspension.

2.2. Matchmaking, Open Challenges & Result Disputes

Sportal provides tools for Users to arrange peer-to-peer matches.

• Result Accuracy: Users are responsible for submitting honest match results. Sportal cannot deploy physical or virtual technology to independently verify match outcomes.
• Dispute Liability: Any disputes arising from a User submitting false or conflicting match results are the sole responsibility of the offending User. Sportal holds no liability for damaged community standings or Sportsmanship Scores resulting from peer disputes.

2.3. Venue Bookings & Access

When a User books a slot at a Venue through Sportal, the contract of service is directly with the Venue.

• Denial of Entry: If a User successfully books and pays for a slot, but the Venue denies entry, is closed, or has allowed someone else to use the booked space, the Venue is solely and entirely at fault. Sportal is not liable for the Venue's operational failures.

2.4. User Subscriptions ("Be a Pro" Plan)

• All purchases of the "Pro Player" subscription plan are final, non-refundable, and non-withdrawable under any circumstances. Once the fee (e.g., 1500 PKR) is processed, the digital perks (Golden Profile Card, etc.) are activated immediately.

2.5. Free Venues (Public Grounds & Community Spaces)

Sportal features a "Free Venues" page that lists local public grounds and community spaces in Pakistan. Please note that Sportal does not own these properties, nor do we have any partnership, agreement, or affiliation with them. These venues are listed strictly for public education and informational purposes, acting as a directory or blog of local areas where youth and communities can play.

• Sportal does not allow the booking or reservation of Free Venues through the Platform.
• No User has the right to claim, hold, or reserve space at any of these free venues by invoking the name or authority of Sportal.
• We do not enforce, guarantee access, or encourage anyone to play at these locations, as Sportal has absolutely no authority or rights over these public properties. Users visiting these locations do so entirely at their own discretion and risk.

3Terms & Conditions for Venues

3.1. Inventory & Slot Availability (Mandatory Commitment)

By registering on Sportal, Venues explicitly agree to make their available real-time inventory and time slots present and bookable on the Platform. Venues must keep their Sportal calendar updated to prevent double-booking.

3.2. Specific Terms for Fitness Venues

• Authenticity: Fitness Venues guarantee that all memberships and subscriptions offered through Sportal are authentic, legally binding, and will be fully honored at their physical location.
• Mandatory Slot Reservation: Fitness facilities acknowledge and agree that listing on Sportal requires the mandatory configuration of a daily slot reservation system. Registration cannot proceed without setting slot availability. Fitness Venues must honor all reservations made by Users through the Platform.

3.3. Service Fulfillment & Double-Booking

Venues are legally and operationally responsible for honoring every booking confirmed through Sportal. If a Venue double-books a slot offline, fails to update their calendar, or denies entry to a User with a valid Sportal booking receipt, the Venue assumes 100% of the liability. Sportal reserves the right to suspend Venues that repeatedly fail to honor bookings.

3.4. Tournament Responsibilities & Liability

Venues possess the ability to host "Paid Tournaments" collecting Entry Fees into a Prize Pool.

• Failure to Host: If a Venue collects payments for a Paid Tournament and the tournament does not take place, is canceled improperly, or the Venue fails to distribute the promised Winning Prize, it is entirely the Venue's legal and financial liability.
• Sportal is completely indemnified from any claims of fraud, theft, or breach of contract regarding Venue-hosted tournaments.

3.5. Venue Promotional Plans

• All purchases of Venue Promotional Plans (e.g., "Economic," "Premium," "Be A Brand") are strictly final and non-refundable.
• There is no withdrawal option once a plan is purchased. The duration of the promotion will run its course as outlined in the selected plan.

4Payments, Escrow, and Refunds

4.1. Payment Processing

Sportal uses third-party payment gateways. Users and Venues agree to comply with the terms of these payment processors.

4.2. Escrow Funds

For specific features (like Tournament Entry Fees), Sportal holds funds in escrow until the event's completion criteria are met. Sportal acts only as a temporary custodian of these funds based on automated system triggers.

4.3. Refund Policy

• Bookings: Refunds for standard bookings are subject to the specific cancellation policy set by the individual Venue.
• Tournaments: If a Tournament is marked "Forfeited" or "Unsuccessful" by the system's strict logic constraints, funds will be refunded to Users' wallets.
• Subscriptions/Promotions: As stated in Sections 2.4 and 3.5, platform subscriptions and marketing plans are completely non-refundable.

5Limitation of Liability & Indemnification

5.1. Limitation of Liability

To the maximum extent permitted by Pakistani law, Sportal, its founders, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to financial loss, personal injury, property damage, or data loss arising from your use of the Platform or physical attendance at any listed Venue.

5.2. Indemnification

You agree to indemnify, defend, and hold harmless Sportal from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of the Platform.

6Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts located in Pakistan.
